I%26#039;ve lived in GA since 1998 and I%26#039;ve only known of ONE time that a father was granted custody. I%26#039;ve always half-joked that a woman would have to be prostituting herself, naked, in the middle of the street at noon, drinking out of a bottle of bourbon WHILE shooting someone in the back with an unregistered gun to have her kids taken away in Georgia. I know of several cases that should have been joint custody that were not granted. The mothers stayed out all night drinking and were neglectful. If you are the dad, get a GOOD lawyer. Make sure THAT lawyer is the one who will show up in court (not some bait and switch where another lesser lawyer in the office shows up). Make sure you have witnesses and documentation. Good luck.

As a mother, let me say this. I know she is toxic to her child right now, but, please, make sure that she knows if she stays clean and sober and takes a positive turn in her life, she will get SOME kind of supervised visitation.

Years ago no matter what the mother did. She got to keep custody. Now courts look down on mothers, that take drugs and drive drunk with the child in the car. If you are clean and have a job you will most likely get custody.
